Those who book a service through GKM TourismTrade llc (hereinafter referred to as ‘TravelRefinery’) are bound to be with the following terms and conditions as this constitutes full acceptance of these general terms and conditions by both TravelRefinery and our esteemed clients, guests, and passengers (hereinafter referred to as ‘Traveller’ and/or ‘Travellers’)
- VISAS, DOCUMENTATION, and INSURANCE:
Each member must have a valid passport. Our rates do not include any charges and fee or other expenses made for passport, visa, travel, and any kind of insurance including but not limited to medical health insurance (This is recommended to be obtained in the origin country that it is the sole responsibility of the Traveller to obtain visa, proper documentation, and insurance.).
- PRICE GUARANTEE & QUOTES:
Quotes will be provided in relation to tour price of the travel arrangements. The quote is valid for a period of 7 calendar days. Deposit of 30 % of the total quote is required to secure the booking once the Traveller confirms services.
- SCOPE OF RATE:
Private tours are relatively more expensive as they are rather convenient and flexible for Travellers who are keen on their privacy. All tour rates include guidance in English (we can provide guidance in other foreign languages subject to your request), air-conditioned mini-van or car and admission fees as specified on the suggested itinerary, if otherwise noted. Travel arrangement prices are quoted for the entire package however itemised component costs cannot be given.
- TIPS & TAXES:
Baggage handling, and VAT taxes are included in the quote. Additional taxes, security charges and other fees collected by governments, airports, airlines, and other entities are not included unless specifically listed as included features. These amounts will appear on your bill and must be included with the final payment.
- NOT INCLUDED IN YOUR RATE:
The following is a list of some major items not covered by the tour rate including but not limited to excess baggage charges, room service charges, items not on portions of menus reserved for individual or group tours lunch or dinner services. TravelRefinery, all items of personal nature such as laundry, telephone, and other communication costs, all the beverages also including bottled water, tea and coffee, meals not detailed in the itinerary, and gratuities, passenger’s airport to ship pier
transfers if air transportation is not purchased as a part of a cruise package and foreign airport departure taxes. Port taxes on cruises are not included in the quote. Tips to the guides and drivers are customary and are left to the discretion of the Travellers.
- PAYMENT SCHEDULE:
All the payments should be received in full 30 calendar days (for individuals) and 60 calendar days (for groups of 10 Travelers or more) prior to the service commencement date subject to one of the options set out below. No service shall be provided unless full payment is received prior to the service commencement date and no responsibility is assumed against the Travellers.
The payments can be made through the following methods:
- The payments can be made by major credit cards VISA and MASTERCARD. When the payment is made by a credit card of American Express, in accordance with the local banking laws, the card will be charged in the local currency (Turkish Lira) and will be exchanged by the card holder’s bank at the exchange rate applicable on the day the bank processes the charge. For this reason, there may be a variation in the price quoted and the actual rate processed on the card holder’s credit card.
USD effective selling rate of the Central Bank of Turkey on the tour commencement day is being used in our calculations at our invoices. The pre-payments made in Turkish Lira should also reflect the USD effective selling rate of the Central Bank of Turkey on the payment date.
- Wire transfer to one of our account numbers the details of which can be obtained on request. All bank charges and fees need to be debited to the sender.
- CANCELLATION:
Reservations may only be cancelled by written notice sent by certified mail (return receipt requested) subject to the cancellation fees below to TravelRefinery.
In the event of cancellation by a Traveller sharing same accommodation, the rate charged to the remaining Traveller will have to be increased to the “Single Occupancy” rate, unless we can arrange for a shared accommodation.
Cancellation fees / charges are agreed to be “Liquidated Damages”, and not a penalty. Deposit towards a tour constitutes full acceptance of these “General Terms & Conditions” and to the cancellation policy as its details given below.
The Cancellation Fees are as follows,
- Cancellation 31 days prior to departure date: 30% nonrefundable
- Cancellation 30 – 15 days prior to departure date: 70% penalty
- 14 days or less prior to departure date: 100% penalty & no refund
- Cancellation policy will be the same with hotel’s cancellation policies unless otherwise stated
- Cancellation policy is subject to change for issued flight tickets according to the Airline Company’s policy.
- Cancellation policy is subject to change for groups consisting of 10 or more guests.
Some hotels may also charge cancellation fee for the group bookings cancelled subject to the cancellation date prior to check-in date. If such a remark is noted on our confirmation sheet this hotel fee will also be charged in full regardless of what is standing above.
- CHANGES:
First 3 changes on the requested services are free. However, for each additional change made to the original booking, a service fee of USD 50 per service will be charged. Furthermore, the related change in fees incurred by the hotels and airlines will also be additionally charged.
Last minute changes just prior to the service commencement date or at the time of implementation stage cause a lot of problems and extra expenses for us. However, we always do our best to assist our esteemed Travellers to comply with their last-minute requests. Any extra costs for such requests should be settled right away while any refunds can only be worked out at the conclusion of the services-30 days later after the completion of the overall services.
- RESPONSIBILITIES AND LIABILITY:
The responsibility of TravelRefinery and / or its suppliers are limited as its details set out below. TravelRefinery and its agents act only as agents for the Travellers in regards to travel whether by air, railroad, motor-coach or any other conveyance and assumes no defect, through the acts or defaults of any company or person engaged in conveying members or in carrying out the arrangements of this tour, or any force majeure event including but not limited to a direct or indirect result of acts of God, dangers incident in the sea, or air, fire, breakdown in machinery or equipment, acts of governments or other authorities, de jure or de facto wars, whether declared or not, hostilities, civil disturbances, strikes, riots, theft, pilferage, epidemics, quarantines, medical or customs regulations or from any other causes.
TravelRefinery can accept no responsibilities for loss or additional expenses to members due to delay or changes in schedule. Tour services included but not limited to guide services, hotel accommodations, meals and other services are furnished by third parties who are independent and do not act for or on behalf of
TravelRefinery and with whom TravelRefinery has no relationship as joint venture or otherwise. Therefore, TravelRefinery shall not be liable or responsible in any way whatsoever for any inconvenience, loss, damage, or injury arising out of or in connection with such tour services, whether same shall be the result of changes in hotel accommodations, food, baggage handling, tour guiding, or any other matter related thereto. All such losses or expenses will have to be borne by the Travellers.
Each Traveller waives any claim against TravelRefinery for any delay, inconvenience or damage, loss of property or baggage or injury to or deaths of persons due to the acts or omissions of said third parties. Any airline / transportation company concerned is not to be held responsible for any act, omission or event during the time Travellers are not aboard their aircraft or conveyances.
TravelRefinery further reserves the right at any time to change any part of the itinerary, or the carrier, or the aircraft utilized, or the hotel accommodations utilized, or any other.
Group departures are available from any departure points worldwide as requested. Each person is also personally liable for any hotel expenses, theatre tickets, souvenirs, gifts, clothing, glasswork, art or any other items of personal property or services purchased by such person. Each Traveller making reservations for or participating in the trip described in these folders or flyers understands and agrees to all terms, conditions and limitations set forth herein.
Medical Conditions-The Traveller must notify TravelRefinery of any pre-existing medical conditions that might reasonably be expected to affect the travel arrangements. Health issues- It is the Travellers responsibility to obtain any vaccinations or health precautions applicable to the country of travel.
- ADDITIONAL SERVICES AND FEATURES:
TravelRefinery reserves the right to cancel the entire trip (or any optional side trips offered in connection with the trip) for any reason at any time before departure of the trip, in which event the liability, if any, for TravelRefinery shall be limited to and liquidated by refunding to each prospective Traveller the moneys, if any, therefore received by TravelRefinery for such Traveller’s trip which moneys have not been or should not be otherwise refunded to said Traveller. We reserve the right to change any part of the itinerary due to circumstances beyond our control.
- SMOKING POLICY:
Smoking is strictly prohibited in the tour vehicles. However, frequent stops are made so that smoking breaks may be taken.
- CHILDREN POLICY:
0-5 years are free only from tour prices however the accommodation price arrangements for children may differ from one to another. The rule for free tour prices for children of 0-5 years applies if the child shares the same room with their parents as the third person on the minimum two-day tours. If a second room is booked for children at the hotels, then no child discount is applicable.
- THE SEQUENCE OF THE VISITS:
Though our guides show the utmost care to follow the itineraries in the same sequence there might be alterations in the sequence of the visits to the scheduled sites and no refund can be demanded for that reason unless any sites or museums are missed.
- BOOKING REQUIREMENTS:
We will sincerely appreciate whether a non-smoking and a twin bedded or king size bedroom are preferred or any other booking requirement is advised at the time of the initial booking.
- EARLY CHECK IN/OUT REQUIREMENTS:
The hotels cannot confirm this until the very last moment as this opportunity is possible only in cases when the hotels are not fully booked on the night prior to check in date or night after the check out. Therefore, it is not possible for us to confirm this well in advance and should be checked through the hotel at the time of the arrival. However, most of the deluxe hotels will require 1 extra night payment. For you information, the general check in time is 2.00/3.00 pm and check out is 11.00/12.00 am in Turkey.
- MISSED CONNECTION FLIGHTS:
If the Travellers miss their local connection flight due to the late arrival of their international flight no responsibility is taken, and all the extra costs are charged from the Travellers. Therefore, short connection time between the international and domestic flights are at the risk of the Travellers.
- AIR TICKETS:
We do not take responsibility for the air tickets that are not issued by TravelRefinery and any reconfirmations or follow ups should directly be handled by the Travellers themselves. We can also not be held responsible for the flight changes/cancellations incurred by the airlines/airports.
- HOTEL RATES:
We intend to provide the Travellers with the most updated hotel rates list. However, on certain time periods like NEW YEAR’S EVE, RELIGIOUS and NATIONAL HOLIDAYS, CONVENTIONS and CONGRESS, etc. almost all the hotels apply surcharge. In addition, hotel rates are dynamic depending on the availabilities/season/demand. Therefore, TravelRefinery keeps the right to revise the quoted hotel rates list at the time of booking. However, once the bookings are confirmed with their specific rates, no further charges are applied.
- RIGHT TO REFUSE:
We reserve any right to refuse any Traveller any part of the tour services, the right to decline to accept or retain any person as a tour participant, should such person’s health, mental or physical condition (or the person’s general conduct) impede the operation of the tour and/or the rights, welfare, or enjoyment of other tour participants. In such cases, our responsibility, if any, will be limited to the refund of costs for any unused tour services.
- LOST AND LEFT ITEMS:
TravelRefinery assumes no responsibility at all for the lost and left items at the time of the tours that this is the sole responsibility of the Traveller. However, if anything returns to us by the hotels and other related parties, we can ship these items on to the required addresses subject to the full shipment fee is payable by the Traveller prior to the shipment of the item.
- THE DISPUTES:
Should the Traveller have any complaints about any of the tour arrangements, these should be immediately brought to the attention of us primarily in good faith, to remedy the problem momentarily.
Furthermore, any such complaints about our tours must be submitted to us in writing, within 15 days after the completion of the services.
- ACCURACY OF THE INFORMATION:
The information submitted to TravelRefinery with regards to the names of the guests and age of children should reflect the passport information. The airlines may deny boarding if the booking and passport names do not match. Therefore, we take no responsibility for any inconvenience stemming from the submission of any inaccurate information.
- PRIVACY
TravelRefinery will not disclose any personal information to any other party without the consent of the Traveller except to the suppliers, a related entity or adviser of TravelRefinery or where TravelRefinery is otherwise required by law or any competent court order to do so.
